Recent developments in Mortgage Foreclosure Law: We will discuss new statutes adopted by the State Legislature to provide better notification of foreclosure actions to borrowers, the extensive court decisions regarding who has standing to foreclose, the role of Intercreditor Agreements in commercial foreclosures and the new Attorney Affirmation requirements. (1.0 Professional Practice NY Non-transitional CLE credit--not acceptable for newly admitted attorneys)
Ethics for Title Company Personnel: In this topic, we will discuss the statutory and regulatory regimes which provide ethical standards for title insurance companies and their employees. The ethical requirements imposed by RESPA, the New York State Insurance Law, and Opinions issued by the Insurance Department's Office of General Counsel will also be discussed. Finally, the effects of statutes governing the unauthorized practice of law upon title insurance companies and their personnel will be reviewed.
